I. General

  1.           DO & CO im Haas Haus Restaurantbetriebs GmbH (hereinafter referred to as “DO&CO HOME”) with the business address Stephansplatz 12, 1010 Vienna operates an online shop for the sale and delivery of food and beverages on the website “www.docohome.com”.

    In order to use the online shop, the customer has to register with his data, whereby DO & CO

II. Scope

  1. For the business relationships between the online shop operated by DO & CO HOME (www.docohome.com) on the one hand and the purchaser of goods (above and below: "Customer") on the other hand, the following general terms and conditions apply exclusively (hereinafter: "GTC") in the version valid at the time of the respective order.
  2. Deviating terms and conditions of the customer are not valid, unless DO & CO HOME has agreed to them in writing before accepting the order. Agreements that differ from the General Terms and Conditions must be made in writing to be effective.
  3. All agreements, in particular verbal agreements with representatives of DO & CO HOME and telephone orders, require written confirmation.

III. Conclusion of contract

  2. The offers from DO & CO HOME contained in the online shop of the “www.docohome.com” website are subject to change and non-binding.
  3. By ordering in the online shop, the customer makes a binding offer to purchase the goods. By placing an order, the customer expressly accepts these terms and conditions. After receipt of the order by DO & CO HOME, the customer will be sent an e-mail with an order confirmation of the order placed by him to the e-mail address provided by him. This order confirmation is deemed to be acceptance of the offer, whereby the contract between the customer and DO & CO HOME is immediately concluded.

  1. The subject of the contract are the goods ordered by the customer and named in the order confirmation at the prices shown in the online shop on the day of the order (plus delivery fee in the event that the customer requests delivery).

V. Order

  1. Orders can be placed around the clock, both on weekdays and on Saturdays, Sundays and public holidays, with orders being processed only on weekdays (Monday to Friday).

VI. Collection

  1. The desired collection date must be specified when ordering. Collection is only possible during the opening times of the respective branch. The opening times and addresses of the branches can be found on the homepage.
  2. The pick-up takes place in the branch specified in the order on the desired pick-up date by the customer. Upon request, the order confirmation must be presented upon collection.
  3. DO & CO HOME provides the ordered goods on the desired collection date and for a period of 1 hour (one hour) from the desired collection date or until the branch closes according to the opening times in the branch specified in the order. If collection does not take place within the aforementioned periods, DO & CO HOME is not obliged to keep the ordered goods available.
  4. The customer is not entitled to a refund of the purchase price if he does not pick up the goods in accordance with point 3 above.

VII. Delivery

  1. If the customer wants a delivery, he has to give his delivery address in the ordering process. Incorrect, incomplete, or unclear information will be borne by the customer. Should a new delivery be necessary as a result, or should additional time of more than 15 minutes arise because of the necessary contact, DO & CO HOME is entitled to charge an additional delivery fee.
  2. If the customer wants a delivery, he has to give his delivery address in the ordering process. Incorrect, incomplete, or unclear information will be borne by the customer. Should a new delivery be necessary as a result, or should additional time of more than 15 minutes arise because of the necessary contact, DO & CO HOME is entitled to charge an additional delivery fee.
  3.          When ordering, the customer can choose a delivery date between 11 a.m. and 11 p.m.

  4.          Delivery is only possible within Vienna's city limits (1st - 23rd district).

  5.          A delivery fee of EUR 12 (twelve euros) must be paid for each delivery.

VIII. Prices and terms of contract

  1. All prices are given in EURO and include the applicable statutory sales tax.
  2. Orders in the online shop must be paid for in advance as part of the ordering process. Payment by credit card (Visa, American Express, Mastercard) is only possible.

 

 

IX. Retention of title

  1. The delivered goods remain the sole and unrestricted property of DO & CO HOME until the purchase price, including all ancillary fees, has been paid in full.

X. Liability/Warranty

  1. DO & CO HOME's liability is limited to damage caused intentionally or through gross negligence. Any indispensable statutory liability provisions are not affected by this.
  2. All products are checked by DO & CO HOME prior to delivery or provision in the branch. The information on the shelf life and storage of the goods must be observed. If the goods purchased from DO & CO HOME are not properly stored or are only consumed after their shelf life has expired, any warranty and liability on the part of DO & CO HOME is excluded.
  3. The customer must examine the goods for defects upon receipt. If the delivered / received goods are damaged, the delivery person or an employee of the respective branch must immediately determine the damage; otherwise, a claim settlement will be rejected. Subsequent complaints will not be accepted.
  4. Defects, which cannot be discovered immediately despite careful examination, must be reported immediately after their discovery, but no later than within one working day after receipt of the goods, otherwise they are deemed to have been approved.
  5. For consumer transactions within the meaning of the Consumer Protection Act (KSchG) or the Distance and Distance Selling Act (FAGG), the general warranty provisions apply, in particular those of the General Civil Code (ABGB).

XI. Right of withdrawl

  1. Contracts concluded in the online shop represent distance sales within the meaning of the FAGG.
  2. It is expressly pointed out that, in accordance with Section 18 FAGG, in the case of distance sales contracts for goods that can spoil quickly or whose expiration date would be exceeded quickly (thus for all meals and homemade beverages) and for goods that are delivered sealed and for reasons of health protection or are not suitable for return for reasons of hygiene, provided that the seal has been removed after delivery, the right of withdrawal is excluded.
  3. For other goods, customers who are consumers within the meaning of the Consumer Protection Act have the right to revoke the contract concluded in the online shop within 14 (fourteen) days without giving a reason.
  4. The cancellation period begins as soon as the customer or a third party named by him has taken over the goods. In the case of a purchase contract for several goods, the cancellation period begins as soon as the customer or a third party named by him has taken over the last partial shipment, the last goods or the last piece. The withdrawal period is 14 (fourteen) days.

by means of a clear statement (e.g. letter sent by post or e-mail) of your decision to withdraw from this contract. To meet the cancellation deadline, it is sufficient for the customer to send the notification of exercising the right of cancellation before the cancellation period has expired.

Consequences of the withdrawal:

If the customer cancels the contract, DO & CO HOME must repay all payments it has received from it, including delivery costs, immediately and at the latest within 14 (fourteen) days from the date on which DO & CO HOME received notification of the cancellation of the contract has been received. For this repayment, DO & CO HOME uses the same means of payment that the customer used for the original transaction, unless something else was expressly agreed; In no case will the customer be charged fees for this repayment. DO & CO HOME can refuse repayment until it has received the goods back or until the customer has provided evidence that the goods have been returned, whichever is earlier.

The costs of the return are to be borne by the customer.

XII. Final provisions

  1. If individual provisions of the contract or these terms and conditions are legally ineffective, this does not result in the invalidity of the entire contract or the entire terms and conditions. The remaining content of the contract or the remaining terms and conditions remain unchanged. Any ineffective provisions will be replaced by new regulations that aim to achieve the same economic success.
  2. The business address of DO & CO HOME in 1010, Vienna, Stephansplatz 12 is agreed as the place of performance.
  3. The competent court in Vienna has exclusive jurisdiction to resolve all disputes arising in connection with the contractual relationship. If the customer is a consumer within the meaning of the Consumer Protection Act, this place of jurisdiction is only agreed if the customer has his place of residence, habitual residence, or place of employment in this district.
  4. The contract is subject to Austrian law to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (UN Sales Convention) and to the exclusion of the reference norms of international private law. If the customer is a consumer within the meaning of the Consumer Protection Act, this choice of law only applies insofar as the protection granted by mandatory provisions of the law of the state in which the consumer has his habitual residence is not withdrawn.
  5. The use of texts, parts of text, images or data from the website and their reproduction requires the prior consent of DO & CO HOME.
